Science Party and OBS techs move on board. Outstanding science tech crew arrive.  UO/UW science teams continue to organize main labs.  Science party orientation with Anthony Johnson. Complete installation and set up of OBS equipment and science party equipment. Prepare for sea.  IHA conference scheduled for 1230 PDT.

 
0436 PDT - e-mail arrives from Purdy indicating that Ecojustice has filed a new court action, possibly in response to them realizing they are going to lose the jurisdictional argument that will be heard later toay.

Court hearing is scheduled for 1000 PDT in federal court of Vancouver, BC.  We are still hoping that the DFA clearance will come through before the hearing is complete.

Hindsight:  At this point in time we do not know that DFO is about to request a more restrictive set of mitigation conditions for the SARA application.  
No outcome at the 1000-1200 LT court hearing.  Judge adjourns until 1530PDT
Liz Tirpak reports that the Canadian DFA told her that they would have the word for her on the clearance before close of business west coast time today.

The conference call goes well.  Discuss details, previous experience from other cruises, attempt to understand different documents from DFO and NMFS.  Because of the court case, DFO is not currently communicating with LDEO.

~1700 PDT - E-mail arrives from Bob Houtman.

Hindsight:  This is the first indication that DFO has changed the rules of the game for our SARA application. A confusing development.
Conference call is requested for 08/21/2009 at 0700 PDT.
Sometime during this day, or the previous evening, DFO Canada requests via a phone call a revised SARA application that includes more restrictive conditions.  Our first indication of this is in an e-mail from Bob Houtman which arrives 08/20/09 4:45 PM PDT.
E-mails fly discussing the relative priorities of: (i) sailing vs. (ii) the new restrictions on mitigation procedures.

Meagan Cummings prepares the 20Aug SARA draft for comments and review.  This goes through some revision.
