Dear Secretary of the Senate Steigelman:

This is pursuant to your email request for a brief report on the activities of FGAC (Faculty Grievance Appeal Committee) for 1999/2000 which arrived a few minutes ago.

The FGAC heard 1 case during academic 1999/2000. Three members of the committee participated in hearing the case: Peter Gilkey (chair), Julia Lesage, Coleen Bell. Since FGAC involves personnel matters, I am not at liberty to discuss any of the specifics of the case we heard. The committee found no difficulty in following the customary and usual procedures in dealing with this case.

I would, however, most respectfully request that the Senate next year take up the question of bringing the Senate/Assembly legislation concerning election to FGAC into accordance with the relevant OAR's concerning election to FGAC as the two are not in concordance.

I should also most respectfully suggest that some means be found of filling "vacancies" in this committee. The Senate/Assembly legislation on the subject specifies that the next highest votegetter be appointed. This year, the committee had 4 members + 1 alternate rather than the mandated 5 members + 1 alternate. This meant that when 2 members of the committee were unable to serve owing to conflicts with other unavoidable University commitments, the FGAC had to proceed with a 3 person committee. I had no choice as chair since there was no method of "filling" out the committee; the normal method of taking the next highest vote getter was not operative this year as the election during 1998/1999 did not yield a sufficient number of candidates. I would suggest that authority in such instances be vested either in the Senate President (acting in consultation with the Senate Executive Committee) or in the Chair of the Faculty Advisory Committee (acting in consultation with the FAC) to replace vacancies on the committee and to add additional members when required. (A Senate committee could, of course, look into the whole election question more generally, but at the very least the question for FGAC needs to be addressed. There are similar problems related to PTRAC).
